The Division of Administration/Office of General Counsel has a vacancy.
The incumbent in this position represents the Division of Administration (DOA) and the Office of State Procurement (OSP) in important and complex litigation before state and federal trial and appellate courts and before administrative tribunals.
The incumbent reports to the OSP General Counsel within the Office of General Counsel (OGC).
The Division of Administration is the state government’s management arm and the hub of its financial operations. Division offices perform a wide variety of activities including the following:- Overseeing the state’s capital construction program
- Working to provide state and federal grants for community development
- Development of the state budget
- Providing technology services
- Giving agencies guidance in the state purchasing and contracting process as they seek goods and services
- Administering a program that provides federal funds to help Louisiana residents recover from a series of devastating hurricanes

Job Duties:
PROGRAM OPERATIONS- The position advises the Chief Procurement Officer (CPO) and OSP General Counsel in the review and approval and/or procurement of supplies, services, and major repairs, and professional, personal, and consulting services contracts. The position is required to possess knowledge of transactional and contractual matters as well as a detailed knowledge of the statutes governing state contracts, procurements, and leases, and all applicable administrative regulations—La. R.S. Titles 38 and 39, and the Louisiana Administrative Code (Title 34, Part V-Government Contracts, Procurement and Property Control.) Procurement matters generating legal issues include, but are not limited to, solicitations, evaluations and scoring, and protests. The position advises and assists with decisions issued by OSP, which are required to be well reasoned, well written and legally sound, as they are susceptible to review by the Commissioner of Administration and are often challenged by unsuccessful proposers and vendors.
- This attorney will represent OSP regarding highly complex procurement activities resulting in the award of State contracts worth hundreds of millions of dollars and the protests, appeals, and litigation involved with unsatisfied bidders. Contracts for virtually every executive branch agency are at issue.
LAWS, RULES, REGULATIONS- Serves as legal counsel to OSP on behalf of OGC and DOA and provides legal advice to OSP under the direction and supervision of the OSP General Counsel. May represent OSP or the Commissioner of Administration in any court proceedings or mediations under the direction and supervision of the OSP General Counsel. The incumbent is required to maintain an advanced knowledge of Louisiana Law, including the Louisiana Administrative Code, Louisiana Procurement Code, Information Technology Procurement Code, Louisiana Administrative Procedure Act, and departmental regulations, as well as state and federal laws, rules and regulations.
- The incumbent provides proactive review of the rules identified in the Louisiana Administrative Code that impact OSP. Coordinates review with appropriate agency personnel to ensure that rules effectively represent the necessary business practices of the office. Identifies areas of non-compliance and drafts and/or assists in the drafting of necessary additions, revisions, or deletions.
LEGISLATION- Drafts and/or assists in the drafting of legislative proposals identified by the Executive Counsel or OSP General Counsel addressing all functions of OSP for consideration by the Commissioner of Administration. Reviews existing legislation for compliance with the operational procedures of those agencies and identifies necessary procedural or legislative changes. Identifies circumstances where legislation could promote more effective administration of the duties of OSP.
- Under the direction and supervision of the OSP General Counsel, coordinates the tracking and monitoring of proposed legislation affecting the mission of OGC or OSP, and collaborates with OGC subject matter experts. Coordinates with staff to prepare legislative impact statements and fiscal notes, including finalizing drafts prior to submission to the Executive Counsel and OGC.
CONTRACTS AND RFP’s- Prepares and/or reviews documents including contracts, memoranda of understanding, letters of agreement, professional service contracts, inter-agency transfer agreements, requests for proposals, invitation to bid, and other procurement documents under the direction and supervision of the OSP General Counsel. Identifies the need for new or additional written procedures and recommends such to the OSP General Counsel and CPO. Assists in the review and performance monitoring of OSP contractors to ensure compliance with contractual provisions. Assists in identifying enforceable contractual provisions for inclusion in the monitoring plans. Provides initial in-house legal review of various procurement documents to ensure compliance.
- This position serves as the OGC Managing Partner to the Office of State Travel (OST). Position renders legal advice and opinions regarding all laws, rules and regulations governing OST, and other OST matters, as needed.
- The incumbent is expected to be familiar with public records law and the handling of public record requests, including but not limited to, scrutinizing documents submitted by an agency in response to a request; determining whether the documents are subject to production or excluded therefrom; redacting the documentation for privileged and confidential information; and communicating with the agency and requestor as well as any other appropriate person (e.g., a proposer).
- The incumbent assists with the Commissioner’s administrative appeal process, advising on and drafting decisions for administrative appeals to the Commissioner based on a review and examination of the appeal, the underlying documents (Requests for Proposals, proposals, responses to public records requests, etc.), and the related procurement rules and case law.
- This attorney may be called upon to perform various duties for the Office of General Counsel on an as needed basis at the direction of the Executive Counsel.
Appointment Type: This vacancy will be filled by a new hire or by promotion of a current permanent status classified employee.

Compensation: This position has a Special Entrance Rate (SER) as follows:- If filled as an Attorney 1, the SER is $2,426.40 biweekly
- If filled as an Attorney 2, the SER is $2,596.00 biweekly
- If filled as an Attorney 3, the SER is $2,920.80 biweekly
- If filled as an Attorney 4, the SER is $3,125.60 biweekly
